SC Multisenzorial SRL processes personal data as a rule for the purposes set out herein, and for each purpose one or more data processing operations may be used, such as collecting, recording, organizing, structuring, storing, adapting or modifying, extracting, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing or destroying them.

We process personal data primarily for the following purposes:

Carrying out the Company's object of activity: organizing cultural events;.

Participation in public, sectoral and/or private projects related to the Company's object of activity, regardless of the Company's status (individual bidder, associated bidder, subcontractor, third party supporter), implementation and running of projects and contracts, fulfillment of obligations in connection therewith including those surviving their termination.

Organization of courses, trainings, events and similar activities.

Management of our relations with clients, suppliers, partners, professionals and experts in the field of engineering, specialized assistance and technical consultancy and related fields, correspondence management, negotiations, contracts, etc.

We process personal data in order to fulfill our contractual obligations and commitments.

Managing the risks related to our business, in which we take security measures to protect personal data, which involves detecting, investigating and addressing security threats. Personal data may be processed as part of physical security monitoring (video data processing) or in the software applications we use. We may also carry out checks on individuals acting as representatives and/or guarantors of customers or partners, legal entities.

In accordance with applicable law, we use the contact details of our customers, partners and collaborators to provide directly or indirectly information that we believe may be of interest to them.

The legal bases of the processing (lawfulness of the processing) take into account the provisions of the REGULATION and the normative acts on the processing of personal data adopted at the level of Romania, the applicable legislation.

processing may be necessary for the fulfillment of a legal obligation incumbent on the firm (e.g. those relating to the management of supporting documents for tax purposes);

the processing is necessary for the performance of a task carried out in the public interest or in the exercise of the aims and objectives of the firm;

the processing is necessary for the purposes of the legitimate interests pursued by the firm or a third party, namely:

for the conduct and administration of our business (in carrying out the firm's object of activity, other related activities, participation in procurement procedures, etc.)

for the management of risks in connection with our business;

for managing our relations with potential donors or partners, including, but not limited to, sending communications containing information about our services and those of our partners, as required by law, organizing specialized courses, etc;

handling complaints/complaints about our services, in order to resolve any issues raised, to improve our services, to exercise or defend a right in court

the processing may be based on your consent, in the cases expressly provided for by the Regulation.

We keep the personal data processed by us only for as long as necessary for the purpose for which it was collected (including as required by applicable law or regulation), such as:

During the performance of the contract/legal relationship for personal data necessary for its performance, including personal data that the firm may come into contact with in the course of the legal relationship, as well as after the termination of the legal relationship in the event that there are provisions that survive termination (such as the obligation to keep documentation in relation to projects implemented with public and/or European funds for a certain period indicated by the acquirer/beneficiary in this regard, etc.);

Until the expiry of the limitation period, as regards cases where the company would have a legitimate interest to retain certain personal data in relation to a potential dispute that may arise between the parties;

For the period prescribed by law in situations where there are applicable regulatory acts in this respect (e.g. in the case of mandatory accounting records and supporting documents underlying entries in the financial accounts, etc.);

For the duration of the management of the relationship with potential donors, beneficiaries of our services, partners of the firm and their representatives, i.e. until the exercise of the right to opt-out, for the transmission of communications containing information about our services, invitations to events such as festivals, presentations, courses, etc.;

Until withdrawal of consent for processing of personal data based solely on consent;

For 2 years from the date of access to the premises of SC Multisenzorial SRL as applicable;

For the period of archiving in the public interest specified by law or in the applicable company policies, as applicable, for data contained in documents for which the law or SC Multisenzorial SRL have provided for archiving.

In any other hypotheses or in the absence of specific legal, regulatory or contractual requirements, our reference period for the retention of personal data is a minimum of 5 years from the date of termination of relations/last contact between the company and the data subject.

Any data may be kept by SC Multisenzorial SRL, by way of exception from the previous provisions if applicable, until the expiration of the limitation period, with regard to situations where the Company would have a legitimate interest to keep certain personal data in connection with a potential dispute that may arise between the parties, for example in the context of the possible legal liability of the Company or the data subject.

In any case, except as provided by applicable law, we delete your data at the time you request us to do so. The applicable exception situations will be communicated to the requester by means of the response submitted to the requester by our association in connection with the request for erasure.

Our firm is responsible for facilitating the exercise of any of your rights listed below.

Any of these rights can be exercised by sending an e-mail to contact@multisenzorial.com or via the website in the "Contact" section.

For the protection of your data, in order to prevent misuse by malicious persons who would seek access to your data, our firm may require you to go through certain identification steps beforehand to ensure that you are the person exercising the rights mentioned below by means of a request. If we receive a request from you to exercise any of the above rights, we may ask you for additional information to verify your identity before acting on your request.

If the data subject makes a request in electronic format to exercise his/her rights, the information will be provided by our association also in electronic format, where possible, unless the data subject requests another format.

We will endeavor to respond promptly to any request from you and, in any event, within the time limits expressly specified by the applicable legal provisions (usually 30 days from the registration of the request). In certain situations expressly provided for by the applicable law, we may charge a fee for a request for access which will take into account the administrative costs necessary to fulfill the request.

In the event that, as a result of the application of legal provisions, our association is unable to comply, in whole or in part, with a request from the data subject for processing, then the applicable exception situations will be communicated to the requester by means of the reply submitted to the requester by our association in relation to the request in question.

Creation of an Account by the Customer

In order to make purchases through the Website, the Customer must first create an account ("Account") on the Website as follows:

(a) either before commencing shopping on the Website

In this case, to create the Account, the Customer has the following options:

Creating the Account by clicking on the relevant button. In this situation, the Customer will fill in the Account creation form providing the following information: the e-mail address through which he wishes to correspond with SC Multisenzorial SRL, name, surname, telephone number and a password;

Account creation through Facebook account. In this situation, the Website will automatically collect the following information from the Customer's Facebook account: name, surname, e-mail address, and the Customer will fill in the telephone number;

Account creation via Google Account. In this situation, the Website will automatically collect the following information from the Customer's Google account: first name, last name, e-mail address, and the Customer will have to fill in the phone number.

b) either before finalizing the order of a Product available on the Website

In this case, after the Customer adds a Product to the shopping cart and accesses (in the shopping cart) the "NEXT STEP" button, the Customer will be asked for his/her e-mail address, based on which the Customer will automatically be created an Account by the Website system. The password for this Account will be randomly chosen by the Website.

SC Multisenzorial SRL will confirm to the Customer the creation of the Account by sending to the Customer (to the e-mail address indicated by the Customer for the automatic creation of the Account) an e-mail to this effect (in the e-mail, SC Multisenzorial SRL will also communicate to the Customer a link through which the Customer will be able to change the password chosen at random by the Website). If the Customer does not enter the e-mail address, the Account cannot be created and, therefore, the order cannot be finalized. If the Customer enters the e-mail address, but then the Customer does not finalize the order, the e-mail address and the other data provided by the Customer will not be stored by SC Multisenzorial SRL, and the created Account will be automatically deleted.

In the event that the respective order is finalized, the Customer will then have the choice between keeping the Account (it will become an Account under the conditions of point a) above) or to renounce this Account.

The Customer shall be responsible for maintaining the confidentiality of his Account details, in particular the password and banking details associated with his Account.

If the password is lost or forgotten, it can be regenerated by accessing the "My Account" box and entering the e-mail address, and a password will be sent by e-mail. The password is strictly confidential.

The Customer is entirely responsible for maintaining the security and confidentiality of the Account and password and is responsible for all activities and conduct of himself or any other person acting Products through the Account. Customer agrees to notify SC Multisenzorial SRL immediately of any suspicion of unauthorized use of the Account or any suspicion of a possible security breach. SC Multisenzorial SRL or its representatives shall not be liable for any loss or damage of any kind that may arise as a result of another person's use of the Account, with or without the Customer's permission. The Customer shall be liable for any loss caused to SC Multisenzorial SRL or any third party as a result of another person's use of the Account.

The Password will not be used to make online payments. The password will only be used for the purpose of registering the Customer and creating an Account in order to place online orders through the Website.

Customers are obligated to provide true, accurate and complete data as indicated on the registration form and to renew, whenever necessary, the registration data to be true, accurate and complete at all times.

In case of fraud or violation of any applicable laws on the part of the Customer, the deactivation of the account will be made without notice, without notice, without further formalities and without compensation, SC Multisenzorial SRL proceeding exclusively to inform the Customer by e-mail.

The Customer who wishes to delete his/her Account can do so by accessing the "Delete Account" button in the "My Account Information" section of his/her Account. The Account cannot be deactivated between the placing of an order and the delivery of that order.

The Website https://multisenzorial.com/ contains Products sold by SC Multisenzorial SRL.

The Products offered for sale are accompanied by a description of them, allowing the Customer to get acquainted with the essential information about the characteristics of the Products before finalizing an order.

The images used to describe the Products on the Website do not represent a contractual obligation on the part of SC Multisenzorial SRL, they are used exclusively for presentation purposes.

The Product offers and prices displayed on the Website are valid as long as they are visible on the Website and within the limit of available stock.

The mere fact of adding Products in the cart does not automatically validate the order, there being the possibility that between the time of adding the Product in the cart, and the time of validation of the Order by the Customer, the Product / Products become unavailable, SC Multisenzorial SRL not being liable for this.

If, after adding a Product to the cart, it becomes unavailable, the Customer will be informed accordingly.

SC Multisenzenzorial SRL may offer the Customer options of Products similar to the Product that has become unavailable. The Customer may choose to add to the shopping cart one of the similar Products presented by SC Multisenzorial SRL or may refuse the Products presented by SC Multisenzorial SRL.

The prices of the Products presented on the Website are expressed in RON and have all taxes included, except transportation costs. The transportation costs will be brought to the Customer's attention before the order is finalized.

The applicable prices are those displayed on the Website when the Customer validates the order. The prices include VAT, and any legal changes made to the amount of this tax will be reflected in the price of the Products present on the Website at the time of entry into force of the relevant legislation. Any other additional charges in respect of certain categories of Products sold on the Website at a given time will be included in the price thereof.

In order to place and register an order, the Customer must follow the instructions displayed on the Website for this purpose. Before the order is validated, the Customer will be provided with a summary of the information relating to the order (number of items ordered, the amount of the order and the address selected for home delivery), and this is validated by clicking on the "finalize order" button.

Orders not validated by clicking on the "finalize order" button will not be honored. The mere fact of adding Products to the shopping cart does not equate to order validation and does not create any obligation for SC Multisenzorial SRL to proceed with the delivery of the Products.

The Website confirms the registration of the order by an automatic e-mail sent to the Customer, through which the following information will be communicated:

the list of items ordered, the prices of the Products, the type of delivery, the address for home delivery; the transportation cost.

In this case, the sales contract shall be deemed to be concluded on the date of receipt by the Customer of the order registration confirmation.

SC Multisenzorial SRL may request additional information about the order, if the information initially provided by the Customer is not sufficient to fulfill the order. In this case, the order will be validated and the contract of sale will be considered concluded only on the date of receipt of the new information requested. If the Customer does not provide the additional information requested, the sales contract will not be considered as validly concluded, SC Multisenzorial SRL has no obligation to honor the order.

The Customer has the possibility to track the status of his orders on the Website by accessing the "Orders" section. The history of transactions made between SC Multisenzorial SRL on the one hand, and the Customer on the other hand, can be consulted at any time on the Website in the "My Account" section.

Payment of orders can be made in the following ways:

Payment on delivery - in cash

Online payment by bank card

All amounts paid by an online Customer by credit card for the purchase of Products through the Website will be transferred by the payment processing service provider to the account of SC Multisenzorial SRL.

All banking transactions on the Website will be carried out in a secure manner, the payment processor being the guarantor of this security from the point of view of making online payments and undertakes to protect all data and personal information related to online payment methods.

In the case of online card payments for the purchase of Products through the Website:

the processing is carried out by the payment processor, SC Multisenzorial SRL having no responsibility in this regard;

the amount of payment for the order will be withdrawn from the card when the payment is validated by the payment processor;

the delivery term of the ordered Product will start to run from the moment of confirmation of the payment made online by card.

The term within which the card issuing bank releases/credits the amount to the Customer's Account cannot be estimated/controlled by SC Multisenzorial SR. and may differ from bank to bank and from order to order.

In case the Customer chooses the cash on delivery (cash on delivery) option, the payment will be made when the Products arrive at the delivery address.

If the Customer pays by card, the processing is done by the payment operator.

SC Multisenzorial SRL reserves the right to suspend/cancel all orders/deliveries in case of refusal of payment by financial-banking institutions (if the Customer has chosen to pay for the Products online or by payment order), without any compensation or notice to the Customer.

All information entered in order to make an online payment (card number, password, card validity date) will not be stored on SC Multisenzorial SRL servers, but will be processed exclusively by the card-issuing banking establishments.

The tax invoice relating to an online order will be issued in electronic format by the seller of the Products, SC Multisenzorial SRL, will be received and will be downloadable and printable no later than 4 days after receipt of the order.

If a Product ordered by the Customer cannot be delivered by SC Multisenzorial SRL for reasons beyond the Customer's control, SC Multisenzorial SRL will inform the Customer in this regard and will refund the Customer's account the value of the Product within a maximum of 14 days from the date on which the Seller became aware of this fact.

The Customer undertakes to be present at the address indicated in the order. If the Customer is not available to accept the order in person, he shall designate another person in his place.

The Customer has the obligation to verify the correctness of the information provided regarding the delivery address before validating the order (street, street number, block/building, number, floor, intercom code, postal code). In case of errors in entering this information, SC Multisenzorial SRL will not be held responsible for the impossibility of delivery of the order, late delivery of the order or for any other consequences.

The delivery of the orders to the delivery address indicated by the Customer is ensured by SC Multisenzorial SRL, through its contractual partners - courier service providers - called "Couriers".

At the request of SC Multisenzenzorial SRL or the Courier, the Customer will prove his identity, if necessary, by one or more documents issued by official authorities and will communicate the order number assigned by the sales system.

The Customer or the person designated by the Customer undertakes to be present at the indicated delivery address during the selected time slot. Failing this, the Customer shall bear the transportation cost of a possible new delivery. The time interval can only be changed after the selection with the Courier's agreement. The delivery is considered to be completed by Povesti Din Bucuresti S.R.L. when the ordered Products are delivered to the Customer at the address selected by the Customer at the time of order validation.

The Customer or the designated person undertakes to check the delivery, the condition of the Products and to sign the delivery document presented by the Courier upon delivery of the ordered Products, to which the invoice containing all the information about the delivered Products (such as Product name, quantity, price) is attached.

SC Multisenzorial SRL undertakes to respond to all requests and complaints within a maximum of 14 working days from their receipt.

For delays in delivery of more than three (10) working days, except in cases of force majeure as defined in the Terms and Conditions or impossibility of functioning of the Website which did not allow the visualization of the order, the Customer is entitled to request the cancellation of the order by an e-mail sent to contact@multisenzorial.com.

Pursuant to art. 16 lit. l) of GEO no. 34/2014, tickets for Multisensorial events, having a fixed date and time, are exempt from the legal right of withdrawal of 14 days. Therefore, tickets once purchased are not returnable and cannot be refunded.

The Customer represents and acknowledges that it agrees to indemnify, defend and hold harmless, SC Multisensorial LLC and its contractual partners and their officers, directors, employees and affiliates, including but not limited to, reasonable attorneys' fees and related costs in connection with or arising out of: (i) breach of these Terms and Conditions by the User, or of any other relevant policies, in particular those relating to privacy; (ii) improper use of the Website, by the Customer; (iii) failure to respect or infringement of copyright or other intellectual property rights or other rights of third parties by breach of the clause - Intellectual Property - of these Terms and Conditions.

SC Multisenzorial SRL will indemnify the Customer for direct damage created as a result of (i) breach of these Terms and Conditions, (ii) culpable actions committed with intent or gross negligence by its own employees. In these two cases, the remedies set out in these Terms and Conditions shall have priority.

All events of force majeure as defined by Romanian law are grounds for suspension and extinction of the obligations of SC Multisenzorial SRL.

Neither party shall be liable for non-performance of its obligations arising from these Terms and Conditions, if such failure to perform on time and/or properly, in whole or in part is due to a force majeure event. Force Majeure is any external, unforeseeable, unforeseeable, absolutely invincible and unavoidable event.

If, within 15 (fifteen) days from the date of its occurrence, the said event does not cease, either party shall be entitled to notify the other party of the cancellation of the order, without either party being entitled to claim any other damages from the other party.

SC Multisenzorial SRL cannot be held liable in these cases of force majeure.
